These Terms of Use ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Claudina Luis Ernesto, an individual, the owner and operator of the MazWiz application ("MazWiz", "we", "us", or "our"), concerning your access to and use of the MazWiz mobile application (the "Application") and its related services (the "Service").
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
Your access to and use of the Service is also conditioned on your acceptance of and compliance with our Privacy Policy. Our Privacy Policy describes our policies on the collection, use, and disclosure of your personal information. Please read our Privacy Policy carefully before using our Service.
To use MazWiz, you must create an account. You agree to provide information that is accurate, complete, and current at all times.
You must be at least 18 years of age to create an account and use the Service. We do not knowingly collect information from or direct any of our content specifically to anyone under 18. If we learn that we have collected personal information from a user under 18, we will terminate the account and delete that information.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree to notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You Own Your Content: You retain any and all of your rights to any Content you submit, post, or display on or through the Service, and you are responsible for protecting those rights.
Our License to Your Content: By posting Content to the Service, you grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, display, reproduce, modify (e.g., for formatting), and distribute such Content on and through the Service. This license is solely for the purpose of operating, developing, providing, and improving the Service. This license ends when you delete your Content or your account.
Your Responsibility: You are solely responsible for the Content that you post, including its legality, reliability, and appropriateness.
You agree not to use the Service to post any Content or engage in any activity that is unlawful, offensive, or otherwise objectionable. This includes, but is not limited to:

We reserve the right to remove any Content and terminate or suspend any account that violates these rules, at our sole discretion.
Opt-In Consent: This feature is entirely optional and requires your explicit, opt-in consent before your location is shared. You must grant the Application permission to access your device's location services.
User Control: You have full control over your visibility on the map. You can hide your location at any time through your profile settings.
Disclaimer and Acknowledgment of Risk: You understand and agree that the map feature is for informational purposes only.
YOU AGREE THAT MAZWIZ (CLAUDINA LUIS ERNESTO) IS NOT RESPONSIBLE OR LIABLE FOR ANY HARM, DAMAGE, OR LOSS OF ANY KIND THAT MAY RESULT FROM YOUR INTERACTIONS WITH OTHER USERS, INCLUDING ANY REAL-WORLD MEETINGS. YOU USE THE MAP FEATURE AND INTERACT WITH OTHERS AT YOUR OWN RISK.
We respect the intellectual property rights of others. If you are a copyright owner and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to copyright@mazwiz.com. Your notice must include a detailed description of the alleged infringement.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will cease immediately. You may terminate your account at any time by simply discontinuing use of the Service or using the account deletion feature if available.
To the maximum extent permitted by applicable law, the Service is provided "AS IS" and "AS AVAILABLE" without warranty of any kind.
IN NO EVENT SHALL MAZWIZ (CLAUDINA LUIS ERNESTO) BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, OR PERSONAL INJURY) ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF THE SERVICE.
Notwithstanding any damages that you might incur, the entire liability of the Company under any provision of this Terms shall be limited to the amount actually paid by you through the Service or 100 USD if you haven't purchased anything through the Service.
You agree to defend, indemnify, and hold harmless MazWiz (Claudina Luis Ernesto) from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.
These Terms shall be governed and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions.
You agree to first try to resolve any dispute informally by contacting us. If a dispute cannot be resolved informally, you agree that the exclusive jurisdiction for any legal action or proceeding relating to your access to or use of the Service shall be the courts located in Lisbon, Portugal.
If you are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect.
